BHARI Terms of Service

Last Updated: October 2026 • Governing use of bhari.in, Bhari Customer App, and Bhari Partner App

1. Acceptance of Terms

By accessing, browsing, or creating an account on bhari.in, downloading the Bhari Customer App, or registering on the Bhari Partner App, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue using the platform immediately.

2. Nature of Platform Intermediary

BHARI is a digital marketplace platform operating as an intermediary under Section 79 of the Information Technology Act, 2000. BHARI facilitates communication and discovery between:

  • Hirers & Customers: Individuals, site engineers, builders, or project managers who submit machinery or material requirements.
  • Equipment Owners & Material Vendors (Partners): Independent third-party operators, fleet owners, and suppliers who maintain equipment or construction inventory.

BHARI does not own or operate heavy machinery directly, nor does it employ machine drivers or operators. Rental terms, operational schedules, and material deliveries are executed directly between the contracting parties.

3. Quotations, Pricing & Zero Direct Commission

  • Direct Negotiations: All equipment rental rates (hourly, daily, monthly shift rates), operator allowances, fuel charges (diesel included vs. separate), and material bulk prices are negotiated and settled directly between hirer and supplier.
  • No Transaction Commissions: BHARI does not deduct percentage commissions from rental transactions or invoice payments.
  • Enquiry Credits: Fleet owners may utilize platform credits to unlock customer contact details for genuine local leads matching their equipment category and radius.

4. Partner Obligations & Operational Compliance

Equipment owners and operators listing on BHARI represent and warrant that:

  • All machinery (JCBs, Cranes, Excavators, Dumpers) holds valid Regional Transport Office (RTO) registration, pollution certificates, and commercial third-party insurance.
  • Operators assigned to machines hold valid heavy motor vehicle (HMV) or specialized equipment licenses required under Indian law.
  • Safety protocols (helmets, high-visibility jackets, crane load charts, jhula harnesses) are strictly adhered to on active construction sites.

5. Prohibited Activities

Users and partners agree not to:

  • Post fraudulent, fictitious, or spam enquiries with no genuine commercial intent.
  • Attempt to scrape, reverse-engineer, or harvest platform lead databases or bypass radius limits.
  • Misrepresent machinery specifications, bucket capacities, or crane tonnage ratings.
  • Circumvent security protections or abuse SMS OTP verification services.

6. Limitation of Liability

To the maximum extent permitted by applicable law, BHARI shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from equipment breakdowns, job site delays, weather-related stoppages, operator negligence, or financial disputes between hirers and machine owners.

7. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, controversy, or claim arising out of or relating to this platform shall be subject to the exclusive jurisdiction of the competent courts in Jaipur, Rajasthan, India.
